Point-of-care ultrasound (POCUS) has emerged as a revolutionary diagnostic tool in modern medicine, valued for its portability, efficiency, and clinical utility across various specialties. However, as its use grows, so does the need to understand and mitigate its associated medico-legal risks. A comprehensive review of Canadian Medical Protective Association (CMPA) cases from 2012 to 2021 underscores this necessity, highlighting 15 medico-legal cases where POCUS was a contributing factor. These cases, out of 58,626 total closed medico-legal cases, uniformly resulted in decisions against the physicians involved, emphasizing the gravity of proper POCUS use.
Primary Triggers
The primary triggers for these medico-legal actions included failure to perform POCUS when clinically indicated, diagnostic errors, incorrect application techniques, and insufficient documentation or reporting. Notably, failure to perform POCUS when needed accounted for nearly 47% of cases. Additionally, inadequate skill or training in performing or interpreting POCUS was another significant contributor. This data reveals that while POCUS is a powerful diagnostic tool, improper or insufficient use can lead to serious legal consequences and compromise patient safety.

To mitigate these risks, it is crucial that healthcare providers receive thorough training in POCUS techniques and interpretation. Ongoing skill assessments, adherence to established guidelines, and meticulous documentation of findings are essential.
